Train To Negotiate - Terms of Service (Washington, USA)
Effective date: October 22, 2026 Entity: Nextgen Telco LLC dba Train To Negotiate ("Train To Negotiate", "we", "us", "our") Address: 6832 St Andrews Dr, Mukilteo, WA 98275, USA Contact: contact@traintonegotiate.com
1) Overview
These Terms of Service ("Terms") govern your access to and use of the Train To Negotiate website, applications, courses, cases and related services (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy and Cookie Policy, which are part of these Terms. If you do not agree, do not use the Service.
2) Eligibility
- 18+ only. The Service is intended solely for people 18 years of age or older.
- Your obligations. You are responsible for complying with the laws that apply where you use the Service.
3) Accounts and security
- Accuracy. Provide accurate information when you register and keep it up to date.
- Security. You are responsible for keeping access to your email and any password safe, and for all activity under your account. Tell us promptly about any unauthorized use.
- One account per person. Accounts are personal; do not share them or create several accounts to obtain additional free matches.
- Termination. We may suspend or terminate your account at any time, with or without notice, including for breach of these Terms, suspected fraud or misuse.
4) Practice, not advice
The Service is a training tool. You negotiate against AI opponents in fictional scenarios ("cases"), and an AI referee judges your moves and writes a debrief.
- AI output is imperfect. Opponent replies, judgments and debriefs are generated by AI and may be inaccurate, inconsistent or incomplete.
- No professional advice. Nothing in the Service is legal, financial, employment or other professional advice. Decisions you make in real negotiations are your own.
- No guaranteed outcomes. We do not guarantee any result in a real negotiation, sale or career.
- Cases are fictional. Names, companies and situations in cases are invented for practice.
5) Your match content
You keep ownership of what you write or say in matches. You grant us a limited licence to store, process and display it as needed to run the Service for you (playing the opponent, judging, debriefs, history and progress). How we handle it is described in our Privacy Policy.
6) Cases, courses and other content
Cases, courses, lessons and debrief methodology are created by us and by the trainers who author them, and are protected by intellectual-property law. You may use them only inside the Service for your own practice. You may not copy, extract, publish or resell them, including a case's hidden information.
7) Free trial, subscriptions and cancellation
- Free trial. New accounts receive a number of free matches, shown in the Service. No card is needed.
- Premium. A subscription includes a monthly allowance of matches shown at purchase; it is generous but not unlimited.
- Pricing and taxes. Prices are shown at purchase and may vary by region, promotions and taxes. We may change prices with notice where the law requires it.
- Auto-renewal. Subscriptions renew automatically until you cancel.
- Cancellation. Cancel at any time with Manage subscription in the Service. Cancellation takes effect at the end of the current billing period; you keep premium until then.
- Payment processing. Payments are handled by Stripe; we do not store full card details.
8) Refunds and right of withdrawal
- General rule. Except where required by law or stated at checkout, fees are non-refundable and partly used periods are not prorated.
- Statutory rights. If your local law gives you a cooling-off or withdrawal right for digital services (for example in the EEA or UK), we honour it as applicable, subject to the lawful exceptions (for example, where you asked for immediate access and acknowledged losing the right).
- Non-conformity. Where the Service fails in a way that triggers non-waivable legal remedies where you live, we provide the remedy the law requires.
- How to ask. Email contact@traintonegotiate.com with your account email, the date and the reason.
Nothing in this section limits any non-waivable rights you have under applicable law; where local law is more protective, it applies.
9) Acceptable use
You agree not to: (a) use the Service if you are under 18; (b) break any law; (c) access accounts or data without authorization; (d) interfere with or overload the Service; (e) use bots, scraping or automated play; (f) try to make the AI reveal a case's hidden information, bypass the rules of a match, or otherwise manipulate the AI systems; (g) submit unlawful, abusive, infringing or fraudulent content; (h) reverse-engineer the Service except where the law allows; or (i) resell or commercially exploit the Service or its content. We may investigate and act, including restricting features or terminating accounts.
10) Feedback
If you send us ideas, suggestions or testimonials ("Feedback"), you grant us a worldwide, non-exclusive, royalty-free, transferable licence to use it in connection with the Service and our business, including marketing. We are not obliged to act on Feedback or to pay for it.
11) Intellectual property; limited licence
The Service (software, content, cases, text, graphics, logos and trademarks) is owned by us and our licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal training. No other rights are granted.
12) Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY AND AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE OR FREE OF BIAS.
13) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTGEN TELCO LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR AI-GENERATED OUTPUT.
IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF US $100 OR THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
Some jurisdictions do not allow certain limitations; where prohibited, these limitations apply to the fullest extent permitted.
14) Indemnification
You agree to indemnify, defend and hold harmless Nextgen Telco LLC and its affiliates, officers, directors, employees, agents and licensors from claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising from your use of the Service, your breach of these Terms, your breach of law, or content you submit.
15) Changes to the Service and these Terms
We may change or discontinue the Service (in whole or in part) and update these Terms. Material changes will be shown by a new effective date or by further notice where the law requires it. Continued use after changes take effect means you accept them.
16) Dispute resolution - arbitration (Washington; FAA); class waiver
Please read carefully - this affects your rights.
- Governing law. Except where preempted by the U.S. Federal Arbitration Act ("FAA"), these Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws rules.
- Informal resolution. Before filing a claim, email contact@traintonegotiate.com with a short description of the dispute and your contact details. We will try to resolve it within 30 days.
- Arbitration. If not resolved, any dispute, claim or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this section.
- Seat, venue, language. The seat of arbitration is King County, Washington; any in-person hearing takes place in Seattle, Washington; proceedings are in English.
- Individual basis only. No class actions or class arbitration. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE OR PRIVATE-ATTORNEY-GENERAL PROCEEDING.
- Small-claims option. Either party may bring an individual action in small-claims court in King County, Washington instead of arbitration.
- Fees and costs. AAA rules govern filing, administration and arbitrator fees. We will consider good-faith requests to reimburse reasonable fees if your claim is not frivolous.
- Severability. If the class waiver in 16(5) is found unenforceable, this entire section 16 is void, and the dispute will proceed in the state or federal courts in King County, Washington.
- Opt-out. You may opt out of arbitration by emailing contact@traintonegotiate.com with the subject "Arbitration Opt-Out", your full name and your account email within 30 days of first accepting these Terms.
- Injunctive and IP relief. Either party may seek temporary or preliminary injunctive relief in court to protect its rights pending arbitration.
17) Copyright notices
If you believe material on the Service infringes your copyright, email contact@traintonegotiate.com with: (a) the copyrighted work and the material claimed to infringe it; (b) your contact information; (c) a statement of good-faith belief; and (d) a statement under penalty of perjury that you are authorized to act.
18) Export and sanctions
You agree to comply with U.S. export-control and sanctions laws and not to use the Service in or for the benefit of embargoed countries or prohibited parties.
19) Electronic communications; notices
You agree to receive communications from us electronically (email and in-product messages). Legal notices to us must be sent to the address above and to contact@traintonegotiate.com.
20) Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign them without restriction.
21) Entire agreement; severability; waiver; language
These Terms (with the policies they include) are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in force. Not enforcing a provision is not a waiver. English is the controlling language.
